Internet Governance in Indonesia

3 min read

Internet Governance in Indonesia is a sentence with a lot of questions in it.
Previously, I was looking for regulations related to the anxiety of content on Quora Indonesia, which contains many words that should not be addressed to someone.
Be it scholars, figures, or ordinary people.
Quora is a question and answer platform that will provide facilities to ask and answer as it is from anyone.
They do not verify the content shared by users.
At least, that’s what Quora wrote in its terms of service.

In general, the ITE Law regulates how electronic distribution and transactions are allowed and not.

The Electronic Information and Transaction Law (abbreviated as UU ITE) or Law number 11 of 2008 is a law that regulates information and electronic transactions, or information technology in general. This law has jurisdiction that applies to every person who performs legal acts as regulated in this Law, both in the territory of Indonesia and outside the jurisdiction of Indonesia, which has legal consequences in the jurisdiction of Indonesia and / or outside the jurisdiction of Indonesia and harms the interests of Indonesia.(wikipedia)

This law has also been amended to Law no. 19 Year 2016 – Amendment to Law No. 11 Year 2008 – Electronic Information and Transactions

But I also couldn’t find the regulation I was looking for.
And finally, I found some light in the Ministry of Communication and Information’s Ministerial Regulation No. 19/2014 on Handling Negatively Charged Internet Sites.

Indeed, there are several points for the prohibition of negative content, especially pornography.
But how can this be used as a reference for site blocking.

Policy Summary

Then I found a Policy Brief prepared by the Institute for Policy Research and Advocacy (ELSAM) related to Internet Governance in Indonesia.
In this summary, I can conclude that there is no specific regulation that is needed for internet governance in Indonesia.
It is a big problem, because day by day the content on the Internet is growing and must be controlled.
An example is the Quora platform, which in my opinion needs to have its license reviewed.

What do you think?
This is probably why there are so many problems arising from inappropriate news or content on the internet and causing riots, clashes and even fostering hatred between groups.
Because in fact, there is no specific and ideal regulation to regulate all of these things.
